The Bykivnia martyrology: Lawyer Arnold Hermanovych Kryster

The publication focuses on the main moments of the history of Soviet repressions against the Ukrainian people during the 1930s. The emphasis has been placed on the research relevance of the specifics of committing criminal acts by the party nomenclature against its own citizens. The aim is to rethink historical events, their personification, honouring the memory of victims, including those buried in the Bykivnia forest. The characteristic features of preconditions and implementation of terror, which include planning and a mass character, falsification of accusations, secrecy of justice, the use of tortures, etc. have been highlighted. On the example of an archival-investigative falsified case of a repressed lawyer A. Kryster it has been shown that after the liquidation of justice and its scientific basis, crimes of the authorities against own people became possible, the initiators and perpetrators of which still remain unpunished. Kryster began his career as a substitute high school teacher at the Department of Civil Law and Judiciary at the Kyiv University of St.Volodymyr. He worked in a special Commission for the study of customary (people’s) law, later headed the section of private law of the Commission of the All-Ukrainian Academy of Sciences for the study of customary law of Ukraine and the Commission for the study of Soviet law. He was successfully involved in the current Soviet law, the development of legislative projects, as well as giving legal advice to government agencies. Together with colleagues, they formulated the appropriate scientific discourse in the process of creation of important codification projects — civil, civil procedure, land and other codes of the Ukrainian republic. Professor A. Kryster also carried out educational activities at the Kyiv Institute of National Economy, prepared a number of valuable scientific papers. In 1937 he was accused of a falsified case and shot in the Bykivnia Forest. He was rehabilitated in February in 1959.
